Bringing someone other than your attorney into the room with you, in general, breaches attorney-client privilege. You are not required to testify about what you tell your attorney. Your attorney is not required to testify about what you tell the attorney. If a third person is present, he or she may be summoned to testify. However, in the context of estate planning, the answer is virtually invariably “so what?” We have no intention of filing a lawsuit. We’re not saying anything that we don’t want other people to hear. We’re all hoping to work together as a family to create a unified estate plan.
